This includes the lack of a process for performing frequent and regular inspections at their active job sites in order to determine if employees will be or are exposed to recognizable hazards.

29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions.  On or about October 18, 2017, the employer failed to provide and require the wearing of personal protective equipment to employees who were exposed to hazards such as but not limited to falls, eye and head injuries.  Employees were working at heights above six feet, using nail guns and walking on the ground below where debris from a residential roof top was being thrown off the roof and onto the ground.

29 CFR 1926.252(a): Whenever materials are dropped more than 20 feet to any point lying outside the exterior walls of the building, an enclosed chute of wood, or equivalent material, shall be used. For the purpose of this paragraph, an enclosed chute is a slide, closed in on all sides, through which material is moved from a high place to a lower one:  On or about October 18, 2017, the employer failed to ensure that a closed waste chute was being used for debris that was being thrown down off of a residential roofing during a roof replacement project.  Roofing debris to include but not limited to shingles, roofing materials and miscellaneous metal pieces, was found on the ground, all around the home and also in an open waste rail car container.
