OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a) Warehouse; On or about October 17, 2017 and at times prior thereto, the employer exposed employees to struck and crush-by hazards in that employees were allowed to walk and work around steel storage racks which were damaged and the column base plates were not anchored to the floor.

29 CFR 1910.176(a): Aisle(s) and passageway(s) were not kept clear and in good repair with no obstruction across or in aisles that could create a hazard. a) Warehouse; On or about October 17, 2017 and at times prior thereto the employer exposed employees to trip and egress hazards in that employees were required to walk and work in aisles that had material stacked in the aisles partially or fully blocking the aisles.
