29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. a. On October 20, 2017, at 6134 Wilmington Pike, Sugarcreek Township, a department store under renovation, the employer did not ensure that fall protection systems were in place before two employees were exposed to a 12 ft. fall hazard when they stepped out of a scissors lift and onto the metal overhang of the store to perform flashing and caulking work.

29 CFR 1926.502(h)(1)(v): The safety monitor shall not have other responsibilities which could take the monitor's attention from the monitoring function. On October 20, 2017, at 6134 Wilmington Pike, Sugarcreek Township, a department store under renovation, two employees were both working on flashing and caulking on an overhang in front of the store and kept the one employee who was acting as a safety monitor's attention away from his responsibilities as a safety monitor.

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted. a. On October 20, 2017, at 6134 Wilmington Pike, Sugarcreek Township,a department store under renovation, two employees were exposed to an approximately 12 ft. fall hazard while installing flashing and caulking on the metal overhang of the store front without utilizing any fall protection. b. On October 20, 2017, at 6134 Wilmington Pike, Sugarcreek Township, a department store under renovation, an employee was exposed to a 12 fall hazard when he stepped off the scissors lift to get onto the metal roof overhang without utilizing any fall protection. Trucraft Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR1926(b)(10), which was contained in OSHA inspection number 973210, citation number 1, item number 1, and was affirmed as a final order on June 24, 2104, with respect to a workplace located at 4779 Red Bank Expressway, Cincinnati, OH 45227.
