OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to atmospheric hazards: On or about October 18, 2017, two employees accessed the top of 24 feet by 80 feet silo to lower and set up the silage unloader. The employees entered the top of the silo without performing atmospheric testing and having an adequate non-entry rescue retrieval system.

29 CFR 1928.51(d): Every employee who operates an agricultural tractor was not informed of operating practices contained in Appendix A of this part and of any other practices dictated by the work environment. Employees who operated agricultural tractors were not provided initial and annual training on safe operating practices when performing field work, feeding and cleaning, and manure handling among other tasks.
