29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about October 20, 2017, the employer failed to protect employees working at ground level from falling objects such as, but not limited to, masonry tools by having employees wear a protective helmet.   Mendez Brothers Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100(a), which was contained in OSHA inspection number 1152061, citation number 01, item number 001 and was affirmed as a final order on July 14, 2016, with respect to a workplace located at 495 Wilmore Avenue, Columbiana, Ohio 44408.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames,  or uprights did not bear on base plates, mud sills or other adequate firm foundation:  On or about October 20, 2017, the employer failed to ensure employees were protected from a fall of approximately 15 feet while performing masonry work by ensuring mud sills were installed on a welded frame scaffold.  Mendez Brothers Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(c)(2), which was contained in OSHA inspection number 1152061, citation number 01, item number 004 and was affirmed as a final order on July 14, 2016, with respect to a workplace located at 495 Wilmore Avenue, Columbiana, Ohio 44408.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  On or about October 20, 2017, the employer failed to ensure employees performing masonry work on a welded tube scaffold were protected from falls of approximately 15 feet by utilizing fall protective systems/devices.  Mendez Brothers Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vii), which was contained in OSHA inspection number 1152061, citation number 01, item number 005 and was affirmed as a final order on July 14, 2016, with respect to a workplace located at 495 Wilmore Avenue, Columbiana, Ohio 44408.

29 CFR 1926.451(h)(2): Employees working below a scaffold were not protected from falling tools, materials or equipment in accordance with the provisions of paragraphs (h)(2)(i)-(v) of this section:  On or about October 20, 2017, the employer failed to ensure employees working below the masons were protected against materials falling off of the welded tube scaffold by utilizing kick plates.  Mendez Brothers Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(h)(2), which was contained in OSHA inspection number 1152061, citation number 01, item number 006 and was affirmed as a final order on July 14, 2016, with respect to a workplace located at 495 Wilmore Avenue, Columbiana, Ohio 44408.
