29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) 1520 Story Avenue, Bronx, NY: On or about 10/18/17, employees who drilled hardened cement that had dripped down through overhead planking onto concrete floors using a pneumatic hammer drill and swept up concrete dust were required to wear respiratory protection (e.g., N95 respirator) and the employer did not provide a medical evaluation to determine the ability of employees to use respirator protection.
