OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees such as struck by from vehicular traffic. On 10/23/2017, at the Bio-Lab job site located at 1700 Old Covington Hwy, SW, Conyers, Georgia, the employer did not require security officer employees, on either day shift or night shift, to don High Visibility apparel so as to alert vehicular traffic as to their location.

29 CFR 1904.39(a)(1): Within eight (8) hours after the death of any employee as a result of a work-related incident, the employer did not report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor. On 10/23/2017, at the Bio-Lab job site, an employee was fatally injured after being struck by a vehicle at approximately 2:30 am. The employer was made aware of this event at approximately 3 am on 10/23/2017. The employer did not report the fatality within 8 hours of its occurrence.
