29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:  (a) Belmont Place Apartments, Building 1000 back side below 3rd floor: On or about 10/25/2017, and at times prior, the employer exposed employees to amputation hazards while cutting decking and siding materials, in that the lower guard was shimmed in the upward position and did not cover the moving blade after the material was cut as the guard remained in the fixed upward position.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) Belmont Place Apartments, Building 1000 on third floor balcony: On or about 10/25/2017, and at times prior, the employer exposed employees to fall hazards of 25-feet from a balcony, in that a fall protection system was not provided to employees who removed the balcony rail to begin repairs to the decking.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  (a) Belmont Place Apartments, Building 1000 third floor balcony: On or about 10/25/2017, and at times prior, the employer failed to inspect all of the electrical cords prior to the start of the work shift. The replacement cord of the Makita Saw was damaged in multiple locations including the strain relief and the cord was not removed from service prior to the start of work.
