29 CFR 1926.59: As referenced by 1910.1200(e)(1): Employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met: On or about October 24, 2017, and at times prior thereto, employees were exposed to chemical hazards from the application of PPG 7-Line Int/Ext Industrial Gloss Oil without the employer developing and implementing a written hazard communication program.

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. On or about October 24, 2017, an employee was exposed to a chemical splash hazard, from the application of PPG 7-Line Int/Ext Industrial Gloss Oil without being provided adequate eye and hand protection such as, but not limited to, safety glasses with side shields and nitrile rubber gloves.
