29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. On the east side of the building, employees working from a Genie aerial lift were not tied off inside of basket while installing break panels. The employees were exposed to a fall hazard of up to 13 feet to the ground below.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On the top of an overhang in front of the building, employees installing break panels were not provided fall protection and exposed to an unprotected fall hazard of up to 16 feet to the ground below.
