The program failed to include methods to inform other employers of any precautionary measures that need to be taken to protect all employees exposed to hazardous chemicals such as, but not limited to, heavy metals and asbestos which are present in various building materials.

Employers shall ensure that each employee has access to labels on containers of lead and to safety data sheets, and is trained in accordance with the requirements of HCS and paragraph (l) of this section.  On or about October 30, 2017, the employer did not ensure lead was included in the hazard communication program for all employees conducting work in the Chamberlain Federal Building.

29 CFR 1960.34(a)(6): The Administrator or the Administrator's designee did not abate unsafe or unhealthful conditions disclosed by reports, investigation or inspections within 30 calendar days or submit to the occupant agency's designated liaison official an abatement plan.  On or about December 18, 2017, the General Services Administration was made aware of lead, arsenic and cadmium contamination in the air handling units in the Chamberlain Federal Building and did not abate the unhealthful conditions within 30 calendar days or submit an abatement plan to the occupant agency's officials.    General Services Administration was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1960.34(a)(6), which was contained in OSHA inspection number 958784, notice number 1, item number 1 and was affirmed as a final order on July 3, 2014, with respect to a workplace located at U.S. Customs House, Room 222, 200 Chestnut Street, Philadelphia, PA 19106.

29 CFR 1910.1025(d)(2): An initial determination was not made to determine if any employee may be exposed to lead at or above the action level:  a) On or about October 30, 2017, the employer did not determine if any employees were exposed to lead at or above the action level when performing tasks such as filter changes and routine cleaning activities.  b) On or about October 4, 2017, the employer did not determine if any employees were exposed to lead at or above the action level after a release of dust and debris containing lead occurred during the removal of an air handling unit and associated duct work.
