29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a. The employer did not ensure that fork lift trucks in need of repair were taken out of service. Employees operating fork-lift trucks in the company's warehouse had been experiencing headaches and nausea during their work shifts. On October 26, 2017 carbon-monoxide levels were measured in the warehouse and found to be as high as 348 parts per million. At least one of the company's three leased fork lift trucks was found to be in disrepair and responsible for the elevated carbon-monoxide levels.
