29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178:        29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):       a) On or about October 25, 2017, the employer did not train and evaluate employees operating the JLG Lull all-terrain forklift.        In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:        a)  On October 25, 2017, employees engaged in construction work were not protected from fall hazards of approximately 40 feet to the ground, while working along an unprotected edge of the deck.       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(3):  Each employee in a hoist area was not protected from falling 6 feet (1.8 m) or more to lower levels by guardrail systems or personal fall arrest systems:        a)  On October 25, 2017, employees were exposed to the hazard of falling approximately 40 feet to the ground while working in the hoist area.    Advanced Masonry and Tuckpointing Services Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(3), which was contained in OSHA inspection number 980467, citation number 1, item number 1 and was affirmed as a final order on September 17, 2014, with respect to a workplace located at 2366 N. Seeley Ave., Chicago, IL 60647.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
