29 CFR 1910.1052(l)(3)(i): The employer did not inform each affected employee of the requirements of 29 CFR 1910.1052 and the information available in its appendices and/or how to access or obtain a copy of it in the workplace: a) At the facility, wash bays: tank cleaners used Ruthless 6030 containing 60-100 percent methylene chloride to remove stickers and labels from chemical containers and the employer did not inform each affected employee of the requirements of 29 CFR 1910.1052 and the information available in its appendices.

29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: a) At the facility, in the wash bay, the employer did not conduct noise exposure monitoring when employees used a pressure washer to clean the interior of steel chemical containers, exposing employees to a hearing loss hazard.
