29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: (a) The employer did not ensure that personal protective equipment was used when beater operators cut baling wire, in that on October 25, 2017, an employee was injured while pulling a cut wire away from a bale of corrugated paper before adding the bale to the pulper. The wire snapped back and punctured the employee's skin behind the left ear. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or were likely to be present, which necessitate the use of personal protective equipment (PPE): (a) The employer did not conduct an adequate hazard assessment in that on October 25, 2017, an employee was injured while pulling a cut wire away from a bale of corrugated paper before adding the bale to the pulper. The wire snapped back and punctured the employee's skin behind the left ear. The employee was wearing the required PPE, a bump cap with a small face shield, but that did not protect the area of the employee's head where the injury occurred. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
