29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles: a) At a single story, residential building under construction, employees using a Hitachi NV45NV2 pneumatic nail-gun are not being protected from flying particle injuries hazards by using eye protection: The employer fails to assure effective protection against flying particles as required by the standard, as demonstrated on October 30, 2017, when two employees installing asphalt roofing shingles on the roof of the building located at 9939 Patriot Ct. Jacksonville, FL 32221, are not protected from flying particle injuries by the use of a personal protection equipment. At a single story, residential building under construction, employees working at elevations of six feet or more above the lower level are not being protected from fall hazards using fall protection systems: The employer fails to assure effective protection against falls as required by the standard, as demonstrated on October 30, 2017, when two employees installing asphalt roofing shingles on the 4:12 pitch roof of a residential building located at 9939 Patriot Ct., Jacksonville, FL 32221, are not protected from a ten (10)-foot fall hazard by the use of a personal fall protection systems.
