OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. On or about November 1, 2017, DKP Construction, LLC had an employee exposed to a fall hazard above 8 feet when elevated on the forks of a SkyTrak Model 6042 Rough Terrain Forklift to install sheathing on the outside of a residential structure and no fall protection was used.
