29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 504 East Beach Boulevard, Gulf Shores, Alabama (Unit M):  On or about November 1, 2017 and at times prior; the controlling employer allowed his subcontractor employees to perform roofing activities without fall protection exposing his employees to a fall hazard of 27 feet to the ground below.  b)  At 504 East Beach Boulevard, Gulf Shores, Alabama (Unit L):  On or about November 1, 2017 and at times prior; the controlling employer allowed his subcontractor employees to perform framing activities without fall protection exposing his employees to a fall hazard of 27 feet to the ground below.  c)  At 504 East Beach Boulevard, Gulf Shores, Alabama (Unit A):  On or about November 1, 2017 and at times prior; the controlling employer allowed his subcontractor employees to perform framing activities without fall protection exposing his employees to a fall hazard of 19 feet to the ground below.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  In Reference:  29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a.  At 504 East Beach Blvd., Gulf Shores, Alabama:  On or about November 1, 2017 and at times prior; the employer allowed his employees to operate a powered industrial truck on site without first ensuring the employee was trained and certified on the safe operations of the vehicle exposing his employee and subcontractor employees to struck-by hazards.
