29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:    On or about November 03, 2017, at the above addressed jobsite, the employer did not develop and implement a written Permit Space program, wherein an employee entered the compartments of a 9, 500 gallon fuel tanker truck, for the purpose of cleaning/repairing/inspecting the tank compartments, during which the four fuel compartments of the tanker, which had previous contained unleaded gasoline, had not been adequately flushed/purged in accordance with an industry recognized procedure, therefore exposing the employee to potentially hazardous atmospheres.          NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.

29 CFR 1910.252(a)(2)(vi)(C): Cutting or welding was permitted in the presence of explosive atmospheres (mixture of flammable gases, vapors, liquids, or dusts with air), or explosive atmospheres that could develop inside uncleaned or improperly prepared tanks or equipment which had previously contained such materials, or that could develop in areas with an accumulation of combustible dusts:    On or about November 03, 2017, at the above addressed jobsite, an employee was using an an oxygen-acetylene torch/performing permit hot-work to heat/loosen/remove the valve mounting studs/bolts from a belly-valve flange on a 9, 500 gallon fuel tanker truck, wherein the four fuel compartments of the tanker, had not been adequately flushed/purged, so as to remove the explosive atmosphere within the fuel compartments, nor did the employer adequately/correctly test the atmosphere in the fuel tank compartments for the presence of an explosive atmosphere before beginning the use, and/or during the use of the oxygen-acetylene torch, which resulted in a fire/explosion and subsequent serious injury to the employee using the oxygen-acetylene torch, and also exposing the other two employees working on the tanker/in the immediate work area to fire/explosion type hazards.    NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.

29 CFR 1910.252(b)(3): Employees exposed to the hazards created by welding, cutting, or brazing operations were not protected by personal protective equipment in accordance with the requirements of 29 CFR 1910.132:(a):    On or about November 03, 2017, at the above addressed jobsite, an employee was using an oxygen-acetylene torch/performing permit hot-work to heat/loosen/remove the valve mounting studs/bolts from a belly-valve flange on a 9, 500 gallon fuel tanker truck, wherein the four fuel compartments of the tanker had not been adequately flushed/purged in preparation for a welding/cutting type operation, which resulted in a fire/explosion, during which the employee who was using the oxygen-acetylene torch was not wearing Personal Protective Equipment (PPE) appropriate for the nature and location of the work performed, which subsequently resulted in serious injury to the employee using the oxygen-acetylene torch, and also exposing the other two employees working on the tanker/in the immediate work area to fire/explosion type hazards.    NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
