OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential struck by hazards from dropped or falling loads or parts: (a) Main Shop, Grate Welding Area - Employees used an upside down V-shaped below-the-hook lifting device to lift grates. The lifting device did not have its rated load marked either on the lifting device's main structure or on an tag attached to the main structure, nor did the lifting device have permanently affixed, durable identification stating the manufacturer, manufacturer's address, serial number, and the lifting device weight (if greater than 100 pounds), exposing employees to the hazard of getting struck by a dropped or falling load or parts, on about November 7, 2017. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
