29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about November 8, 2017, a subcontractors employees were exposed to a fall of approximately 12 feet. The employees were performing masonry activities on a new commercial building located at 1150 North Freedom, Ravenna, Ohio 44266. The subcontractors employees were working from a supported scaffold that did not have a complete guard rail system and they were not using any other form of fall protection.

29 CFR 1926.451(h)(2): Employees working below a scaffold were not protected from falling tools, materials or equipment in accordance with the provisions of paragraphs (h)(2)(i)-(v) of this section: On or about November 8, 2017, subcontractors employees were exposed to a struck by hazard. The subcontractors employees were performing masonry activities on a new commercial building located at 1150 North Freedom, Ravenna, Ohio 44266. The subcontractors employees were working below a supported scaffold with tools and materials on the upper working level. The working level did not have toe boards installed to prevent the materials from falling.
