29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that posed a hazard by falling or rolling into excavations and protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a) Intersection: Windy Hill Rd & Rocking Hill Rd., Marietta, GA: On or about November 11, 2017, the employer exposed employees to struck-by hazards in that the spoil pile was 1.5ft away from the edge of the trench. The spoil pile contained materials such as, but not limited to; stones, rock and hard clumps of hard clay.

(a) Intersection: Windy Hill Rd & Rocking Hill Rd., Marietta, GA: On or about November 11, 2017, the employer exposed employees to cave-in hazards in that they were connecting a 6 inch water pipe to an existing 10 inch ductile water pipe without cave-in protection.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) Intersection: Windy Hill Rd & Rocking Hill Rd., Marietta, GA: On or about November 11, 2017, the employer exposed employees to fall hazards in that a portable ladder used for access was not at least three feet above the upper landing surface. The employee was digging out a trench to install a water line. The ladder was approximately 1.5 feet above the upper landing surface.
