29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. On November 8, 2017, an employee was using an aerial lift to access and egress a two story new construction commercial building flat roof. The employee was stepping out of the aerial lift basket onto the roof through the 24" wide parapet framing and back into the aerial lift basket from the roof through the parapet framing. The employee did not have his fall protection lanyard attached to an anchorage point or the basket.
