29 CFR 1910.29(b)(1): The top edge height of top rails, or equivalent guardrail system members, were not 42 inches, plus or minus 3 inches, above the walking-working surface: At the time of the inspection, sections of the guardrail in the second floor of the elevator were less than the minimum height of 39 inches. The guard rail had been installed to prevent a fall to a lower elevation 12 feet below.
