29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) E & E Construction, LLC at 116 East 69th Street, Sioux Falls, SD 57105: On or about and at times prior to November 9, 2017, the employer did not ensure that each employee was protected from falls from heights in that eight employees were conducting tear off operations as well as installing asphalt shingles and ice and water barrier without being attached to their personal fall arrest system. This condition exposed the employees to a fall hazard of approximately 24 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) E & E Construction, LLC at 116 East 69th Street, Sioux Falls, SD 57105: On or about and at times prior to November 9, 2017, the employer did not ensure that each employee engaged in roofing operations on a commercial property, had been trained to recognize the hazards associated with working at elevations over 6 feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet. The condition exposed employees to the hazard of falling from an elevation of approximately 24 feet.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. The condition exposed employees to the hazard of falling from an elevation of approximately 13 feet 4 inches.
