29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    (a) New townhome construction on Lot #39, Roof: On or about 11/13/2017, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic nail guns at 120 PSI, in that employees were not provided with protective eyewear while engaged in framing activities.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     (a) New townhome construction located on Lot #39, Roof: On or about 11/13/2017, and at times prior, the employer exposed employees to fall hazards of over 32-feet, 7-inches to the lower level, in that a fall protection system was not provided to employees engaged in framing activities.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge:    (a) New townhome construction located on Lot #39, Stairway between second and third floors: On or about 11/13/2017, and at times prior, the employer exposed employees to fall hazards, in that employees used a stairway to access the third level which was not equipped with a stair rail along the open side of the stairway. Employees were exposed to falls of up to 5-feet, 1-inch to the lower level.

29 CFR 1926.1053(a)(2): Ladder rungs, cleats, and/or steps were not parallel, level, and uniformly spaced when the ladder was in position for use:    (a) New townhome construction located on Lot #39, Third floor to roof access: On or about 11/13/2017, and at times prior, the employer exposed employees to fall hazards of up to 13-feet, 2-inches to the lower level, in that the job made ladder provided did not have uniform rungs/cleats as the space between the rungs were up to 30-inches from the roof landing area. Rung/cleat spaces were 11-inches, 12-inches, and 30-inches on the top half of the ladder.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    (a) New townhome construction located on Lot #39, Third level to roof access: On or about 11/13/2017, and at times prior, the employer exposed employees to fall hazards of 13-feet, 2-inches to the lower level, in that a ladder extended at least 3-feet past the roof landing was not provided to employees accessing the lower level.
