29 CFR 1910.212(a)(3)(ii): Points of operation of machinery were not guarded to prevent employees from having any part of their body in the danger zones during operating cycles: (a) Simon Contractors, Inc. at 19441 US Highway 34, Fort Morgan, CO 80701: On and before November 13, 2017, the employer did not guard the point of operation to prevent employees from having any part of their body in the danger zone during operating cycles. Employees operated a rebar cutting machine (sheer type) without adequate guarding at the point of operation. This condition exposed employees to amputation and laceration hazards.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazards in the workplace, including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: (a) Simon Contractors, Inc. at 19441 US Highway 34, Fort Morgan, CO 80701: On and before November 13, 2017, the employer did not identify and evaluate the respiratory hazards in the workplace, including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form. The employer did not assess the exposure of each employee who may reasonably be expected to be exposed to respirable crystalline silica. This condition exposed employees to respiratory hazards.
