29 CFR 1910.176(a): Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. a. At the workplace located at 35 Rix Mills Road, New Concord, Ohio, in the packaging department, the employer failed to assure that permanent aisles and passageways were marked in areas where there were pedestrian traffic, pallets of product staged, and powered industrial vehicles operating, for temporary workers supplied to NFI Industries, thereby exposing employees to a struck-by hazard. Inergroup Insourcing Solutions supplied temporary workers and floor supervisors, who worked in areas with pedestrian and powered industrial vehicle traffic, to NFI Industries.

29 CFR 1910.178(l)(4)(i): Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely. a. On or about November 2, 2017, the employer failed to provide refresher training and evaluation, or assure refresher training and evaluation was performed, to a temporary worker that was observed operating a forklift in an unsafe manner and involved in a near-miss incident prior to permitting the operator to continue operating the forklift. The temporary worker did not receive refresher training and evaluation from Inergroup Insourcing Soultions, from NFI Industries or in some combined fashion by these shared employers.
