29 CFR 1926.652(g)(1)(iii): Employees shall be protected from the hazard of cave-ins when entering or exiting the areas protected by shields. a. On or about November 15, 2017 at the Hap Cremean project, employees walked out of a trench box to access the earth ramp and were exposed to a cave-in hazard of approximately 5 feet 2 inches.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. a. On or about November 15, 2017 at the Hap Cremean project, all employees working in the trench that was approximately 6 feet deep were not protected from cave-ins. The Kenmore Construction Co., Inc. was previously cited for a violation of this occupational safety and health standard its equivalent standard 1926.651(c)(2), which was contained in OSHA inspection number 948748, citation number 1, item number 1, and was affirmed as a final order on January 30, 2014, with respect to a workplace located at 705 Graham Rd, Cuyahoga Falls, OH 44221.
