29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): On or about November 15, 2017, at the intersection of NW 5th Street and NW 1st Avenue, the employer had not provided any type of cave-in protection for an employee that had been sent inside the excavation which was 9' in depth, 12' in length, and 6' in width, and class C soil, exposing the employee to an engulfment hazard.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: On or about November 15, 2017, at the intersection of NW 5th Street and NW1st Ave, 50 feet West of NW1 Ave, in Miami, FL, the employer had not provided a ladder that extended 3' above the landing of the excavation which was 9' in depth, 12' in length, 6' in width, and class C soil, exposing the employee to a fall/engulfment hazard.
