29 CFR 1910.28(b)(1)(i): (1) Unprotected sides and edges.  (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following:     (A) Guardrail systems;  (B) Safety net systems; or  (C) Personal Fall protection systems, such as personal fall arrest, travel restraint, or positioning systems.    a) The employer did not ensure that employees working around the cement hopper pit were not protected by a conventional fall protection system, the potential fall height was approximately 5 feet.     b) The employer did not ensure that employees working form the mixer access platform located above the hopper pit were protected by conventional a fall protection system, the potential fall height was approximately 8 feet.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.    (a) On 5/31/17 an employee was in the process of clearing a misalignment between the concrete transfer car system and the pins on the floor. The employee was reaching up under the car to engage a switch to align the car with the floor pin, when the car activated, moved and caught the employees finger between the switch and the cart.    (b) The in running nip point on the pulley located on the rotating brush at the cubing machine was not guarded.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.    (a)  On November 7, 2017 the employer became aware that an employee received a partial finger amputation as a result of a work related injury and the employer did not report it to OSHA within twenty-four (24).
