29 CFR 1910.120(q)(1): The employer did not develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations. The plan was not in writing and available for inspection and copying by employees, their representatives and OSHA personnel. Employers who planned to evacuate their employees from the danger area when an emergency occurred, and who do not permit any of their employees to assist in handling the emergency did not provide an emergency action plan in accordance with 29 CFR 1910.38: Employees were exposed to hydrogen sulfide releases while working on oil wells, and the employer did not establish either a written emergency response plan, or an emergency action plan when employees were expected to evacuate an area.

Gesell's Pump Sales and Service, Inc., Whittington, Illinois: On or about November 17, 2017, the employer did not record the following workplace injuries and illnesses on the OSHA 300 Log for the calendar year 2017. -On or about May 23, 2017, a recordable injury occurred when an employee was placed on days away from work after being exposed to a release of hydrogen sulfide gas that emitted from an oil well.
