Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized crushed-by hazards that were causing or likely to cause death or serious physical harm to his employees: (a) This violation occurred on or about November 11, 2017 when employees loading/unloading materials onto unmarked/unsecured storage racks were exposed to a crushed-by hazard: (1) Storage racks within cooler 1; (2) Storage racks within cooler 2; (3) Storage racks within cooler 3.

Except as provided elsewhere in this section or by other subparts of this part, the employer did not ensure each employee on a walking-working surface 4 feet (1.2m) or more above a lower level was protected from falling by: (i) Guardrail systems; (ii) Safety net systems; or (iii) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems: (a) This violation occurred on or about November 11, 2017 inside cooler number two, when an employee climbing a storage rack in order to make repairs to it was exposed to a fall hazard of approximately seven feet six inches.
