OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a.) Vertical Seal Company, on or about February 22nd, 2018 and times prior thereto: Employees were potentially exposed to struck-by or crushing hazards from a powered industrial truck that was not equipped with a proper operator restraint system. A Caterpillar brand forklift (Model: T70 C; Serial # 94M556) was not equipped with an operator restraint system (i.e.-seatbelt). Employees operated the forklift for activities that included, but were not limited to, loading and unloading metal bearings.

29 CFR 1910.134(i)(5)(i): Compressors used to supply breathing air to respirators were not so constructed and situated so as to prevent entry of contaminated air into the air-supply system: a.) Vertical Seal Company, Compressor room area, on or about February 22nd, 2018 and times prior thereto: A Clemco industries brand supplied air system (ABL-4021), used to supply breathing air to a supplied air respirator for an employee working in the blast area booth, was attached to a compressor room where propane-fueled powered industrial trucks traveled next to throughout the day. Employees performing work operations with the supplied air respirator were potentially exposed to carbon monoxide emitted from the exhausts of the propane fueled powered industrial trucks. b.) Vertical Seal Company, Compressor room area, on or about February 22nd and times prior thereto: A Clemco industries brand supplied air system (ABL-4021), used to supply breathing air to a supplied air respirator for an employee working in the blast area booth, was attached to a compressor room. The exhaust ducting from a Reznor brand (propane fueled) furnace was located directly next to the compressor room. Employees performing work operations with the supplied air respirator were potentially exposed to carbon monoxide emitted from the exhaust ducting of the furnace.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a.) Vertical Seal Company, Bead blast area, on or about November 17th, 2017 and times prior thereto: Employees were required to wear Supplied-Air respirators (Clemco brand Apollo #600 series) during bead blasting of parts in the bead blast area of the facility. The company's written Respiratory Protection Program did not include site specific information including, but not limited to, the following: 1) The program did not specify the type of respirators required to be used at this specific worksite and procedures to ensure adequate air quality, quantity, and flow of breathing air for atmosphere-supplying respirators. 2) Identification of the physician or other licensed health care professional that will conduct medical evaluations.

Vertical Seal Company, Emergency Eyewash/shower station on the East side of the Babbitt room area, on or about November 17th, 2017 and times prior thereto: Employees worked with and around corrosive chemicals including, but not limited to, Johnsons Soldering fluid (Zinc Ammonium Chloride). The plumbed emergency eyewash/shower station in the Babbitt room was not in compliance with ANSI/ISEA 358.1-2014 for Emergency Eyewash and Shower Equipment in that: 1) The eyewash unit did not provide adequate flushing fluid upon activation. 2) Weekly activation of the eyewash and shower were not being conducted weekly to verify proper operation.
