29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: (a) Jobsite: On or about November 17, 2017, an employee was standing on the midrail of a scissor lift to perform work. The fall hazard was about 13 feet.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. (a) Jobsite: On or about November 17, 2017, two employees were working form an aerial lift and were not tied off.

29 CFR 1926.503(c)(3): 29 CFR 1926.503(c)(3): When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill, the employer shall retrain the affected employee: (a) Jobsite: On or about November 17, 2017, all three employees that were working from either a scissor lift or from an aerial lift, need to be retrained in how to recognize fall hazards and in the methods to use to reduce the risk of falling.
