29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means, as set forth in subparagraphs (i) - (iii) of this paragraph. a) Julio Sanchez dba J & A Interiors on or about November 20, 2017, at the address of 2850 Navarre Rd. Oregon, OH: The employer failed to ensure the welded frame scaffold system from which employees were working during plastering activities was secured at or below the 4:1 height to width ratio. The 40 ft. high by 5 ft. wide scaffold system did not maintain a securing means to the adjacent structure until the height of 32 ft. Employees were exposed to falls, in that adequate stability of the system was not provided while performing work tasks from the scaffold.

29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part: (a) Julio Sanchez dba J & A Interiors on or about November 20, 2017, at the address of 2850 Navarre Rd. Oregon, OH: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards commonly associated within their scope of work, decreasing the probability of employee injury and/or illness.
