29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. There was no frequent and regular inspection program being maintained in use by a competent person knowledgeable of the fall protection regulation requirements to ensure the job site, materials and equipment such as residential unprotected window wall openings of the central interior stairwell landings and interior floor areas of the 2nd, 3rd and 4th floors fall protection devices or systems were being maintained and utilized in a safe condition.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Located along central interior stairwell landings and interior floor areas of the 2nd, 3rd and 4th floors of the residential structure employee(s) were exposed to unprotected window wall openings without conventional fall protection and exposed to fall hazards in excess of 20 feet.
