The employer failed to ensure each personal fall protection system meets the requirements in 29 CFR part 1910, subpart I; and use it a) An employee operated stock/cherry picker not wearing safety belt/harness. The employee operated the stock picker in the warehouse going back and forth, raised it up to 15 feet to unstack cases from racks, exposing the employee to fall hazard.

29 CFR 1910.30(a)(1): (a) Fall hazards. (1) Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. a) On or about November 21, 2017 and at times prior to, employees operated stock (cherry) picker to un-stack cases from racks in the warehouse. The employer did not ensure employees were trained on fall hazards on or before May 17, 2017 as required.
