OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and caught-between hazards: a. On or about January 19, 2018, the company's Hyster Karry Kranes number 309 and number 312 had defective brakes in that the brakes had to be pumped before they would function to stop the vehicles, exposing employees to struck-by and caught-between hazards.

Except as provided elsewhere in this section or by other subparts of 29 CFR part 1910, the employer must ensure each employee on a walking-working surface 4 feet (1.2 m) or more above a lower level is protected from falling: a. On or about January 19, 2018 and times prior thereto, employees were exposed to fall hazards associated with accessing the top of tanks in order to perform welding operations without fall protection. Employees were exposed to fall hazards of as much as 12 feet or greater.

29 CFR 1910.184(c)(6): Slings shall be securely attached to their loads. a) On or about November 13, 2017 an employee suffered a crushing injury when the hook on the sling that the employee was using to lift a tank came out of the tank's pad eye resulting in the tank falling onto the employees left arm.

The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. a.
