29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On Nov. 22, 2017, there were no frequent and regular inspections being performed by a competent person to ensure the jobsite, materials and equipment such as residential fall protection systems and/or devices were being maintained and utilized in a safe condition.

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection.  On Nov. 22, 2017, located on the north side of a residential roof structure, employees were not provided with fall protection equipment before beginning roofing work at a potential fall height greater than 17 feet above the hard ground below.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  On Nov. 22, 2017, located on the south side of a residential roof structure, employees were observed using a 20 foot extension ladder to gain roof access. The ladder did not extend at least 3 feet above the upper landing surface; was improperly positioned over the roof eave corner, which would cause the ladder to slip under load; and was not secured at its top.

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.  On Nov. 22, 2017, located on the north side of a residential roof structure, employees were observed performing roofing work on a low-slope roof while not utilizing a fall protection system. Potential fall heights were measured to be greater than 17 feet above the hard ground below.  Campos Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1115792, citation number 2, item number 1 and was affirmed as a final order on 2/12/16, with respect to a workplace located at 9007 Fields Ertal Rd., Cincinnati OH 45249.  Campos Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 917207, citation number 1, item number 1 and was affirmed as a final order on 8/15/13, with respect to a workplace located at 333 Delaware Dr., Maineville OH 45039.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The employer did not provide a training program for employees that were observed performing roofing work on a residential roof structure while not utilizing a fall protection system and exposed to potential fall heights in excess of 17 feet.   Campos Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1115792, citation number 1, item number 1 and was affirmed as a final order on 2/12/16, with respect to a workplace located at 9007 Fields Ertal Rd., Cincinnati OH 45249.
