The condition was most recently observed near 3715 Bates Street, St. Louis, MO when the employer failed to ensure workers were protected by protective helmets while working in close proximity to the excavator while soil was removed from the excavation and while the excavator hoisted the shoring system into the excavation.

29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition): The employer is failing to protect employees from struck-by hazards. The condition was most recently observed near 3715 Bates Street, St. Louis, MO 63116 when the employer failed to ensure signaling by flaggers conformed to Part VI of the Manual on Uniform Traffic Control Devices. The flaggers failed to utilize Stop/Slow paddles or flags and the flagger stations were not located such that approaching road users had sufficient distance to stop.
