29 CFR 1926.1052(c)(1)(i): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail:     a) On or about November 27, 2017, a stairway having 13 risers used to access and egress the second story deck of the building was not equipped with at least on handrail.      In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):                   a) On or about November 27, 2017, employees were exposed to the hazard of falling while removing roof sheathing and other material without the benefit of fall protection from an 8/12 pitched roof having a ground to eave height of approximately 12 feet.     b) On or about November 27, 2017, employees were exposed to the hazard of falling approximately 10 feet from second story window/wall openings where the benefit of fall protection was not provided.    c) On or about November 27, 2017, employees were exposed to the hazard of falling approximately 8 feet from a second story deck adjacent to the stairway where the benefit of fall protection was not provided.      MG Bros Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13) which was contained in OSHA inspection number 781822, citation 1, item 1, and was affirmed as a final order on January 31, 2013, with respect to a worksite located at 2002-2008 W Erie Street, Chicago, Illinois.           In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
