OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to fire and explosion hazards form hydrogen gas. On or about November 28, 2017, employees operating annealing Furnace #2 and Furnace #3 were exposed to fire and explosion hazards due to hydrogen gas emitting from the open exit end of both furnaces. Among other methods, on feasible and acceptable method to correct this hazard includes, but is not limited to, include to follow the National Fire Protection Association NFPA 86 Standard for Ovens and Furnaces, 2015 Edition, Chapter 13.5.11.2 requiring a burn-off pilot, glow plug, flame screen or other source of ignition to be provided and located at the gas-air interface and sized to reliably ignite the flammable special atmosphere gas that is released at open ends.

29 CFR 1910.178(c)(2)(iv): Power-operated industrial trucks designated as DY, EE, or EX were not used in locations where volatile flammable liquids or flammable gases are handled, processed or used, but in which the hazardous liquids, vapors or gases will normally be confined within closed containers or closed systems from which they can escape only in case of accidental rupture or breakdown of such containers or systems, or in the case of abnormal operation of equipment; also in locations in which hazardous concentrations of gases or vapors are normally prevented by positive mechanical ventilation but which might become hazardous through failure or abnormal operation of the ventilating equipment; or in locations which are adjacent to Class I, Division 1 locations, and to which hazardous concentrations of gases or vapors might occasionally be communicated unless such communication is prevented by adequate positive-pressure ventilation from a source of clear air, and effective safeguards against ventilation failure are provided. On November 28, 2018, the employer did not ensure that the powered industrial trucks used near and around the annealing furnaces were designated as DY, EE or EX in the event that hydrogen gas from the furnaces would escape under abnormal conditions and reach hazardous concentrations.

On or about November 28, 2017, equipment and installations of equipment in the areas around the annealing furnaces, a Class 1, Division 1 and 2 locations, were not intrinsically safe, approved for the hazardous locations, or safe for the hazardous locations. a) Propane forklifts were used in the areas around the annealing furnaces that were not rated for Class 1, Division 1 and 2 locations. b) Standard electrical outlets, fluorescent lighting, open vented electrical cabinets, electrical transformers and motors were used in areas around the annealing furnaces that were not rated for Class 1, Division 1 and 2 locations.
