OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from vehicles when working in the company yard. a) Worksite, 3947 Middle Country Rd., Calverton, NY- Drivers walk across the yard to check in, check out, and to get to their trucks and personal vehicles. Trucks move through the yard at the start and end of day as well as when refilling the propane tanks. Yard employees also work around the yard throughout the day repositioning trucks, performing maintenance and cleanup activities on the trucks and the facility. Truck drivers and yard workers are exposed to struck-by hazards from vehicular traffic: on or about 11/28/2017. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
