29 CFR 1910.213(j)(3): Each hand-fed jointer with a horizontal cutting head did not have an automatic guard which will cover all the section of the head on the working side of the fence or gage and effectively keep the operator's hand from coming in contact with the revolving knives. The guard did not automatically adjust itself to cover the unused portion of the head and remain in contact with the material at all times.    A) Adroit Thinking, Inc., doing business as 5 Acre Mill, located at 10860 OH State Route 2, Hicksville, OH 43526: On or about November 17, 2017, the employer did not ensure that employee(s) using the Delta DJ-20 Jointer (Model # 37-350, Serial # JOO 8275), located on the production floor, were adequately protected from coming in contact with the revolving knifes. Employees were not utilizing push stick(s) in conjunction with the automatic guard installed on the Delta DJ-20 Jointer, as instructed by the manufacture to ensure effective guarding from the point of operation. As a result, employees were not protected from amputation hazards while performing tasks such as, but not limited to, jointing edges of the boards ranging in size from two to four inches wide/high and from twenty to forty-five inches long.

29 CFR 1910.1030(c)(1)(i): The employer having employee(s) with occupational exposure did not establish a written Exposure Control Plan designed to eliminate or minimize employee exposure:     A)    Adroit Thinking, Inc., doing business as 5 Acre Mill, located at 10860 OH State Route 2, Hicksville, OH 43526: On or about November 17, 2017, the employer did not establish a written site-specific Exposure Control Plan which includes all sections outlined in 29 CFR 1910.1030(c)(1)(ii) in order to eliminate or minimize employees exposure to blood-borne pathogens. The employee was exposed to blood-borne hazards while the employee cleaned the Delta DJ-20 Jointer (Model # 37-350, Serial # JOO 8275) and the area where one employee suffered partial amputation of the middle finger on left hand.

29 CFR 1910.1030(g)(2)(i): The employer shall train each employee with occupational exposure in accordance with the requirements of this section. Such training must be provided at no cost to the employee and during working hours. The employer shall institute a training program and ensure employee participation in the program:     A)    Adroit Thinking, Inc., doing business as 5 Acre Mill, located at 10860 OH State Route 2, Hicksville, OH 43526: On or about November 17, 2017, the employer did not ensure that each employee with occupational exposure to blood-borne hazards was trained in accordance with the 29 CFR 1910.1030 standard. Such training should have taken place at the time of the employees initial assignment, and should have covered items such as, but not limited to, a copy of the regulatory text of the 1910.1030 standard, explanations of the modes of transmission of blood-borne pathogens, and a general explanation of the epidemiology and symptoms of blood-borne diseases.

29 CFR 1904.39(a)(2): The employer failed to report the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, within (24) twenty-four hours:     A)    Adroit Thinking, Inc., doing business as 5 Acre Mill, located at 10860 OH State Route 2, Hicksville, OH 43526: On or about November 17, 2017, the employer did not report a personal injury incident when one employee sustained partial amputation of the middle finger on left hand. The employer or employer representative did not contact the OSHA Toledo Area Office or the 24 hour OSHA number to notify the agency of a personal injury incident, resulting in partial amputation of the middle finger on left hand, within 24 hours of occurrence. The incident happened on November 17, 2017, at approximately 0730 hours.  The employer later contacted the OSHA through the 24 hour number on November 22, 2017.
