29 CFR 1910.1000(c): Employee(s) were exposed to silica, crystalline quartz (respirable) listed in Table Z-3, in excess of 10 mg/m3 / %SiO2 + 2 as an 8 hour Time Weighted Average (TWA) concentration: On or about January 30, 2018, the employer is failing to ensure that employees are not exposed to levels of crystalline silica that exceed the Permissible Exposure Limit (PEL)in the following instances: A) An employee (#1) packing bricks in the reblend building, was exposed to crystalline silica for an 8 hour TWA of 1.09 milligrams per cubic meter (mg/m3), approximately 2.03 times the calculated PEL of .53 mg/m3. Sampling was performed for 420 minutes and zero exposure was assumed for the 60 minutes not sampled. B) An employee (#2) packing bricks/tumbler operator in the reblend building, was exposed to crystalline silica for an 8 hour TWA of .90 mg/m3, approximately 1.09 times the calculated PEL of .83 mg/m3. Sampling was performed for 448 minutes and zero exposure was assumed for the 32 minutes not sampled. C) An employee (#3) operating the basic saw in the saw room adjacent to reblend, was exposed to crystalline silica for an 8 hour TWA of .95 mg/m3, approximately 1.08 times the calculated PEL of .88 mg/m3. Sampling was performed for 365 minutes and zero exposure was assumed for the 115 minutes not sampled.
