29 CFR 1926..20(b)(2): Employers programs did not provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers: (a) Cherokee Street Townhomes located at 249 Cherokee Street NE, Marietta, GA, Excavation: On or about 11/30/2017, and at times prior, the employer exposed employees to cave-in/engulfment hazards, in that an inspection of the excavation was not performed prior to the start of work. Several indications of failure including fissures were not addressed by the competent person prior to allowing employees to work at the base of the wall without a cave-in protective system.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) Cherokee Street Townhomes located at 249 Cherokee Street NE, Marietta, Excavation: On or about 11/30/2017, and at times prior, the employer exposed employees to cave-in/engulfment hazards, in that a shoring system or cave-in protection system was not provided to employees installing concrete formwork and rebar in close proximity to a unprotected 14-foot b-type soil wall.
