29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: Instances: 1) On or about 11/29/17, at the above address jobsite, an employee conducting carpentry work was exposed to continuous noise at 66.13% dose of the permissible daily noise exposure ( 8- hour time weighted average sound level of 90dbA) or an equivalent sound level of approximately 87.0 dbA during the 285-minute sampling period on 11/29/17; exposure calculations included a zero increment for the 195 minutes not sampled. 2) On or about 11/29/17, at the above address jobsite, an employee conducting carpentry work was exposed to continuous noise at 81.86% dose of the permissible daily noise exposure ( 8- hour time weighted average sound level of 90dbA) or an equivalent sound level of approximately 88.5 dbA during the 281-minute sampling period on 11/29/17; exposure calculations included a zero increment for the 199 minutes not sampled. 3) On or about 11/29/17, at the above address jobsite, an employee conducting carpentry work was exposed to continuous noise at 127.4% dose of the permissible daily noise exposure ( 8- hour time weighted average sound level of 90dbA) or an equivalent sound level of approximately 91.7 dbA during the 284-minute sampling period on 11/29/17; exposure calculations included a zero increment for the 196 minutes not sampled.
