OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees Employees were exposed to a struck-by hazard when Rack R suffered a catastrophic collapse on November 27, 2017. The rack had the bottom beam removed down the entire length of the rack to allow for totes to be double stacked to accommodate for having oxidizers and corrosives to be stored separately. The removal of the bottom beam reduced the capacity of each bay from 21,100 pounds to approximately 6,400 pounds. Of the 34 bays, every bay was over the 6,400 pound reduced capacity and over 20% of the bays were twice the reduced capacity.
