29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) In the Facility, on or about January 4, 2018 - The employer did not institute a continuing effective hearing conservation program when employee noise exposures exceed an 8-hour time-weighted average sound level of 85 dBA. An employee designated as a machine operator was exposed to noise at a level of 81.5% of the allowable limit during a 241 minute sampling period on January 4, 2018. This exposure is equivalent to a sound level of 88.5 dBA for the dose and time of employee exposure and is 1.63 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required. b) In the Facility, on or about January 4, 2018 - An employee designated as a machine operator was exposed to noise at a level of 90.8% of the allowable limit during a 241 minute sampling period on January 4, 2018. This exposure is equivalent to a sound level of 89.3 dBA for the dose and time of employee exposure and is 1.81 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required. c) In the Facility, on or about January 4, 2018 - An employee designated as a machine operator was exposed to noise at a level of 395% of the allowable limit during a 242 minute sampling period on January 4, 2018. This exposure is equivalent to a sound level of 99.9 dBA for the dose and time of employee exposure and is 7.9 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required.
